Former Member of Parliament (MP) for the Zebilla Constituency in the Upper East Region and Private Legal Practitioner, John Ndebugri, has served notice that he will take legal action against the Bawku West Disrict Assembly if it fails to elect a Presiding Member before approving the newly nominated District Chief Executive (DCE) for the area.
For the past five years, some 5 District Assemblies in the Upper East Region have been running without Presiding Members.
These districts include Bawku West, Binduri, Builsa South, Talensi and Tempane Districts.
The situation, Mr. Ndebugri said was worrying and will not hesitate to take legal action against his own district if it fails to elect a presiding Member before confirming the DCE nominee.
“According to the law, the first meeting of any first assembly is convened by the co-ordinating Director. And the single agenda of that meeting is to elect the presiding member; after which the Presiding Member will convene a meeting to consider the President’s nominee for Metropolitan, Municipal or District Chief Executive as the case may be. So, you cannot have a District Chief Executive without a Presiding Member just like how you cannot have a president without a speaker of Parliament.”
“They’ve just been ignoring the law and doing whatever they like. And I’ve decided that it is high time we corrected it. So if the Bawku West District Assembly tries [same] this time, I will take it to court so that the court will clarify the situation for us.” He spoke on A Radio
