Daddy Lumba’s Family files suit to block body release, freeze funeral account

Five individuals who say they are the immediate maternal principal family members of the late highlife icon, Charles Kwadwo Fosu, popularly known as Daddy Lumba, have filed a writ at the High Court in Accra seeking to halt the release of the musician’s body without their consent.
The plaintiffs are Obaapanyin Afia Adomah Pakoso, Robert Gyamfi, also known as Wofa Yaw Poku Asuafua, Georgina Gyamfi, Ernestina Fosuh, and Nana Afia Kobi Pakoso, all residents of Kumasi.
In the suit dated December 3, the plaintiffs are asking the court to order the third defendant, Transitions Funeral Home, to withhold the body of Daddy Lumba from any person or group unless approved by them.
The defendants named in the action are Kofi Owusu Abuakwa of Kumasi, CAL Bank Ghana, and Transitions Funeral Home in Accra.
The family, among other reliefs, is seeking a court order directing, “The 3rd defendant [Transitions Funeral Home] not to release the body of Charles Kwadwo Fosu a.k.a Daddy Lumba to any person [s] without the knowledge, consent and approval of the Plaintiffs.”
The plaintiffs are also seeking multiple orders relating to the Daddy Lumba Memorial Foundation account held at CAL Bank. They want the court to restrain the first defendant and members of a dissolved committee from accessing the foundation’s account, said to be used for the musician’s funeral arrangements.
They further requested an order directing the first defendant to account for, refund, and surrender any funds or items withdrawn from the account after the dissolution of the committee.
In addition, the plaintiffs are asking the court to restrain CAL Bank from honouring any cheques presented by the first defendant or under his authority in relation to the foundation’s funeral account.
They are also seeking an order compelling the bank to remove existing signatories to the account and replace them with signatories from a newly constituted committee to be appointed by the head of Daddy Lumba’s immediate family.
Finally, the plaintiffs want the court to issue a perpetual injunction barring the defendants, their agents, or anyone acting on their behalf from taking any action related to the final funeral rites of the late musician.
The late music icon is scheduled to be buried on Saturday, December 13.
