ADR a means to decongesting our Courts – Her Ladyship Justice Larbi

Justice of the Court of Appeal who doubles as the Judge-In-Charge of Alternative Dispute Resolution (ADR), has indicated that its use will go a long way to decongest our courts which is over burdened with cases that take longer than usual to resolve.

This according to Her Ladyship will allow judges to have more time to handle cases which are not amenable to the ADR, with a resultant satisfaction and confidence of court users in the judicial delivery system.

This was made known during the launch of the ADR week celebrations in Tamale, Wednesday 21 July,2021.

The week long celebration which commenced on Monday 19th July will end on 23rd July 2021, and is on the theme; “Making our courts user friendly through the use of ADR”.

It emerged that in 2020, the settlement rate through the use of ADR was 2,312 cases out of a total of 5,455 representing 42% which according to Her Ladyship Justice Irene – Charity Larbi is non satisfactory.

She thus encouraged Ghanaians to use ADR in resolving their conflicts which according to her will help the lawyers decongest the backlog of cases before them and  allow a smooth hearing of cases that are above the level of the ADR.

The ADR was instituted in 2005 as an intervention to ease pressure on the regular court system and to create a platform that will offer disputants the opportunity to play a key role in resolving their own disputes.

The concept which serves as a compliment to the traditional court system, makes access to justice delivery more cheaper, easier, expeditious, non-adversarial and faster for the citizenry.

In order to make it accessible to Ghanaians,the ADR programme has been extended to 131 courts across the nation with at least five mediators assigned to each of these courts.
